Seller's liability to Buyer for damages (except for death or bodily damages caused by gross negligence or criminal offence), whether under breach of warranty or any other cause whatsoever, and whether under these Terms and Conditions or otherwise, shall in no event exceed that part of the purchase price applicable to the portion of the Product giving rise to Buyer's claim for such damages.
