การเลือกปฏิบัติด้านราคาที่ผิดกฎหมายสามารถเกิดขึน้ได้
เมื่อผู้ขายเก็บเงินจากลูกค้าบุคคลหน่ึงในราคาหน่ึงสําหรับ
ผลิตภัณฑ์ แต่ต้องการให้ลูกค้าอีกบุคคลหน่ึงที่แข่งขัน
กับบุคคลแรกชําระเงินในราคาที่สูงกว่าสําหรับผลิตภัณฑ์
เดียวกัน การปฏิบัติจะไม่เป็นการผิดกฎหมายหากผู้ขาย
เรียกเก็บเงินกับลูกค้าปลายทางในราคาที่สูงกว่าที่ผู้ขาย
เรียกเก็บจากผู้จัดจําหน่าย เพราะผู้ซือ้สองคนน้ีอยู่ ในระดับ
