Since 2013, the executive leadership selects 16–18 high per forming, high potential associates each year to par ticipate in the NextGen leadership development program. For ty high-per forming associates were selected by our executive team to par ticipate in the 2023 program. These selections considered key performance indicators including workplace diversity, environmental and social metrics.

This included unprecedented raw material infl ation, spiking logistics costs and select end market weakness. The USEPA issued its Record of Decision (ROD) in September 2018, selecting a remedy consistent with our accrual assumptions. In March 2016, the USEPA issued a ROD selecting a remedy for an eight-mile portion of the LPRSA at an estimated and discounted cost of $1.4 billion.

For ty- four high-per forming associates were selected by our executive team to par ticipate in the 2022 program. These selections considered ESG key performance indicators including workplace diversity. Further, based on assessment of global risk, we select certain specific countries or functional groups within Avient for focused training or audits.

Except to the extent solely attributable to the gross negligence or willful misconduct of Seller, Buyer will indemnify, defend and hold Seller harmless from all costs, expenses, damages, judgments or other loss, including without limitation costs of investigation, litigation and reasonable attorney’s fees (“Buyer Indemnity Costs”), arising out of Buyer’s selection, use, sale or further processing of the Product or Buyer’s product made therefrom.

Except to the extent attributable to the Product sold hereunder failing to meet the express warranties set forth in paragraph 2, Buyer will indemnify, defend and hold Seller harmless from all costs, expenses, damages, judgements or other loss, including costs of investigation, litigation and reasonable attorney's fees, arising out of Buyer's selection, use, sale and further processing of the Product sold hereunder.
